1. What FirstSolo is — and is not
FirstSolo is an independent study tool that helps you prepare for the FAA Private Pilot Airplane knowledge test. It generates practice questions from FAA reference material, grades your answers with an AI examiner (the “AI DPE”) modelled on the oral portion of the practical test, and tracks what you have learned.
It is not the FAA knowledge test, not an FAA-approved course, and not a substitute for instruction. We are not affiliated with or endorsed by the Federal Aviation Administration or any testing centre. Using the service does not earn an endorsement, a certificate, a rating or any credit toward one; only an authorized instructor can endorse you to take the knowledge test, and only the FAA issues certificates.
2. AI-generated content can be wrong
Questions, answer keys, explanations, grades and examiner feedback are produced by artificial intelligence. We take real care — every question is written from cited reference notes and checked by an independent verification step before you see it — but AI makes mistakes, and verification does not catch all of them. A question may be poorly worded, a key may be wrong, an explanation may be outdated as regulations and publications change, and a grade may be unfair.
Treat everything in the service as study material, not authority. The authoritative sources are the current FAA publications — 14 CFR, the Aeronautical Information Manual, the Pilot’s Handbook of Aeronautical Knowledge, the Airplane Flying Handbook, the Airman Certification Standards and the applicable Advisory Circulars — and your certified flight instructor. Verify anything you intend to rely on, especially anything related to the safety of flight, against those sources and with your instructor. Never use the service as a source of operational or in-flight information.
3. Your account
You sign in with a one-time code sent to your email address, or with your Google or Apple account; keeping access to that mailbox and those accounts secure is your responsibility, and everything done from your account is treated as done by you. One person per account; do not share it. You must be at least 13 years old to use the service. You can rename your account or delete it — along with everything in it — at any time from the account page.
4. Credits
The service is paid for with credits. Every new account receives a free opening balance, once per person: an address, Google account or Apple account that has had an account with us before starts without one. Credits are charged only for work you see — questions served to you and the AI examiner’s grading, follow-up and discussion turns — at the prices in force when your session started; question writing, verification and retries are never charged. Credits have no cash value, are not transferable, cannot be exchanged for money, and may be withdrawn if they were obtained through abuse of the service. Free opening credits are a promotional grant we may change or discontinue for new accounts.
You can buy more at any time from your account page. Packs are 100 credits for $39, 500 credits for $59 and 1,000 credits for $99. Prices are in US dollars and do not include sales tax or VAT, which is added at checkout where your billing address makes it due. These are one-off purchases — there is no subscription and nothing renews automatically. Credits are added to your balance as soon as the payment succeeds, they do not expire, and they are spent oldest-first as you study. We may change pack prices; the price shown when you pay is the price you pay.
Payments are taken by Stripe, not by us. Your card details are entered on Stripe’s own payment page and never reach our servers. Charges appear on your statement as FIRSTSOLO.AI — Average Quality, LLC is the merchant of record. Stripe emails you a receipt for every payment.
5. Refunds
Credits work immediately, so what can be returned is what you have not used. Write to [email protected] within 14 days of a purchase and we will refund the unused part of it — the credits that purchase added and you have not yet spent — to the card you paid with, together with any tax charged on that part. Credits you have already spent on questions, grading or discussion are not refundable, because the work was done.
Refunds are made in the currency you paid and usually reach your statement within five to ten business days, depending on your bank. When we refund a purchase we remove the corresponding credits from your balance; if you have spent more than you are refunded, your balance can go below zero and the shortfall is forgiven the next time you top up.
If something goes wrong at our end — the service is unavailable for a prolonged period, you were charged twice, or a purchase was made on your account without your permission — tell us and we will put it right, inside or outside the 14 days.
If you are a consumer in the UK or the EU, you normally have 14 days to withdraw from a purchase of digital content. By buying credits you ask us to make them available immediately and accept that you lose that right for the credits you go on to spend; the unused part remains refundable for the 14 days, as above. Nothing here affects rights you have by law that cannot be waived.
6. Acceptable use
You agree not to:
- use the service in any way that is unlawful, harmful to others, or that interferes with its operation;
- access it by automated means, scrape it, or attempt to extract its question generation, reference notes, prompts or models in bulk;
- create multiple accounts to obtain free credits, or otherwise circumvent limits or pricing;
- attempt to break, probe or bypass its security or the accounts of others;
- resell, sublicense or commercially redistribute the service or its content.
We may suspend or terminate accounts that breach these terms, and remove content or credits obtained through a breach.
7. Content and intellectual property
The service, its software, design, and the questions, explanations and other material it generates are ours or licensed to us. FAA publications referenced by the service are works of the United States Government and are cited, not owned, by us. You receive a personal, non-exclusive, non-transferable licence to use the service and its content for your own study. You keep the rights to the answers and messages you write; you grant us a licence to store and process them to provide the service, as described in the Privacy Policy. We do not use them to train AI models.
8. No warranty
The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that questions or grades will be correct, or that using it will result in passing any test. Your results depend on your own study.
9. Limitation of liability
To the fullest extent permitted by law, FirstSolo and the people who operate it will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or opportunity, arising from or related to the service or its content — including any decision or action taken in reliance on AI-generated material — even if advised of the possibility. Our total liability for any claim relating to the service is limited to the amount you paid us for it in the twelve months before the claim, or one hundred US dollars, whichever is greater. Some jurisdictions do not allow some of these limitations; in those places they apply only as far as the law allows.
10. Indemnity
You agree to indemnify us against claims, damages and reasonable costs arising from your breach of these terms or your misuse of the service.
11. Changes and termination
We may change the service — including its features, prices and these terms — and will revise the effective date above when we do. For material changes we will let signed-in users know in the app or by email; continuing to use the service after a change means you accept it. We may suspend or end the service, or your access to it, at any time; you may stop using it or delete your account at any time. Sections 2, 6, 7, 8, 9 and 11 survive termination.
12. Governing law
These terms are governed by the laws of the State of Texas and of the United States, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts sitting in Texas, and you and we agree to their jurisdiction. If you are a consumer elsewhere, this does not take away the protection of laws that apply to you and cannot be set aside by agreement.
